Terms of Service
The terms that govern your use of the Blacksight AI platform.

These Terms of Service ("Terms") govern your access to and use of the Blacksight AI platform, including the website at blacksight.ai, the browser extension, the gateway appliance, and the management dashboard (collectively, the "Service"), provided by Blacksight AI ("Blacksight," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and have the authority to bind the organization on whose behalf you are using the Service. If you are using the Service on behalf of a company or other entity, you represent that you have the authority to accept these Terms on its behalf.
2. Account registration
You must create an account to use the Service. You agree to provide accurate, current, and complete information, and to keep your account credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
3. Description of the Service
Blacksight is a data loss prevention platform that monitors and controls data sent to AI services. The Service includes:
- Browser extension — scans prompts typed into AI web applications before they are submitted.
- Gateway appliance — a hardware device that inspects AI-bound network traffic across your office network.
- Dashboard — a web-based management console for viewing activity, configuring policies, managing users, and generating compliance reports.
DLP scanning runs locally on your devices and network. By default, only scan metadata (verdicts, timestamps, policy outcomes) is transmitted to Blacksight servers. Prompt content is not transmitted unless your administrator explicitly enables that feature.
4. Subscriptions and billing
4.1 Plans
The Service is offered under several subscription tiers, including a free tier. Plan details, features, and pricing are described on our Pricing page and may change with 30 days' notice.
4.2 Free tier
The free tier is limited to 5 devices and provides monitoring with count-only reporting. No credit card is required. We reserve the right to modify or discontinue the free tier at any time with 30 days' notice.
4.3 Paid subscriptions
Paid subscriptions are billed monthly or annually in advance. All fees are non-refundable except as required by law. If you upgrade mid-cycle, you will be charged a prorated amount for the remainder of the billing period. If you downgrade, the new rate takes effect at the next billing cycle.
4.4 Payment
Payment is processed by Stripe. By providing payment information, you authorize us to charge the applicable fees. You are responsible for all taxes associated with your use of the Service.
4.5 Overdue payments
If payment fails, we will notify you and provide a 14-day grace period. If payment is not received within the grace period, we may suspend or downgrade your account.
5. Gateway hardware
5.1 Purchase
Gateway appliances are sold separately from software subscriptions. Hardware pricing is listed on our Pricing page. A paid software subscription (Business tier or above) is required to operate a gateway.
5.2 Warranty
Gateway hardware is covered by a 2-year limited warranty against defects in materials and workmanship under normal use. The warranty does not cover damage from misuse, unauthorized modification, or environmental factors. Warranty claims should be directed to [email protected].
5.3 Returns
Unused gateway hardware may be returned within 30 days of delivery for a full refund. Hardware that has been installed and used may be returned within 30 days for a refund minus a 15% restocking fee. Shipping costs for returns are the customer's responsibility.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Reverse engineer, decompile, or disassemble the Service or any component thereof.
- Attempt to gain unauthorized access to the Service, other accounts, or systems connected to the Service.
- Use the Service to monitor individuals without proper legal authority and required disclosures under applicable law.
- Interfere with or disrupt the integrity or performance of the Service.
- Resell or redistribute the Service without a written reseller agreement.
7. Your data
7.1 Ownership
You retain all rights to the data you and your users generate. We do not claim ownership of your scan metadata, policy configurations, or any prompt content (if prompt logging is enabled).
7.2 License to us
You grant us a limited license to process your data solely to provide, maintain, and improve the Service. We do not use your data to train machine learning models or for any purpose outside of delivering the Service.
7.3 Data processing
Our processing of personal data on your behalf is governed by our Privacy Policy. For customers requiring a Data Processing Agreement (DPA), contact [email protected].
8. Intellectual property
The Service, including its software, design, documentation, and trademarks, is owned by Blacksight AI and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand features without prior written consent. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes during the term of your subscription.
9. Third-party services
The Service integrates with third-party AI services (ChatGPT, Claude, Gemini, etc.) for the purpose of monitoring prompts sent to them. We are not affiliated with these services and are not responsible for their availability, accuracy, or terms. Your use of third-party AI services is governed by their respective terms.
10. Availability and support
We aim to maintain 99.9% uptime for the dashboard and API. The browser extension and gateway operate locally and are not dependent on our servers for core scanning functionality. We provide support via email during business hours. Paid plans include priority support with faster response times as described on the Pricing page.
11. Termination
11.1 By you
You may cancel your subscription at any time through the dashboard. Cancellation takes effect at the end of the current billing period. Your data will be available for export for 30 days after cancellation.
11.2 By us
We may suspend or terminate your account if you violate these Terms, fail to pay fees after the grace period, or if we are required to do so by law. We will provide reasonable notice except in cases of serious violations or legal requirements.
11.3 Effect of termination
Upon termination, your right to use the Service ceases. We will delete your data within 90 days of termination unless retention is required by law or requested by you for export purposes.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT GUARANTEE THAT THE SERVICE WILL DETECT ALL INSTANCES OF SENSITIVE DATA IN ALL CIRCUMSTANCES.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLACKSIGHT'S TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO BLACKSIGHT IN THE 12 MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL BLACKSIGHT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, REGARDLESS OF THE THEORY OF LIABILITY.
14. Indemnification
You agree to indemnify and hold harmless Blacksight, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
15. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Texas. Both parties consent to the exclusive jurisdiction of those courts.
16. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on our website at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and cancel your subscription.
17. General
- Entire agreement — these Terms, together with the Privacy Policy and any order forms, constitute the entire agreement between you and Blacksight.
- Severability — if any provision is found unenforceable, the remaining provisions remain in full force.
- Waiver — failure to enforce any provision does not constitute a waiver of that provision.
- Assignment — you may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of all or substantially all of our assets.
